अमित शाह के कथित चचेरे भाई जस्टिस मोहित शाह का भी कोई कनेक्शन है सीबीआई जज लोया की मृत्यु से ?
सोहराबुद्दीन शेख एंकाउंटर केस की सुनवाई कर रहे जस्टिस लोया की रहस्यमय मृत्यु पर विवाद बढ़ता ही जा रहा है। ‘कैरावन’ की एक रिपोर्ट के बाद यह विवाद तूल पकड़ा।
विवाद के बीच ‘इंडियन एक्सप्रेस’ में विवेक देशपांडे और मयूरा जँवालकर की रिपोर्ट प्रकाशित हुई जिसमें सुचिंतित ढंग से ‘कैरावन’ की रिपोर्ट के प्रत्येक बिंदु का एक प्रतिपक्ष पेश किया गया। हालाँकि ‘इंडियन एक्सप्रेस’ की रिपोर्ट सवालों के घेरे में आ गई क्योंकि इस रिपोर्ट में न जज के परिजनों को सौ करोड़ की रिश्वत की पेशकश पर बात थी, न यह कि सीबीआई ने फैसले के खिलाफ अपील क्यों नहीं की ? ये असल मुद्दे हैं। मोबाइल से कॉल डिटेल गायब होने की बात पर भी कुछ नहीं था।

सुप्रीम कोर्ट के वरिष्ठ अधिवक्ता प्रशांत भूषण ने ‘इंडियन एक्सप्रेस’ की रिपोर्ट पर सवाल उठाते हुए ट्वीट किया जस्टिस लोया के ईसीजी के नाम पर ईसीजी की जो तस्वीर छापी है वह 30 नवंबर 2014 की तारीख़ के ईसीजी की तस्वीर है, जबकि जस्टिस लोया की मृत्यु 1 दिसंबर 2014 के दिन हुई थी और उसी दिन उन्हें अस्पताल ले जाया गया था।
इसके बाद, एक बात साफ है कि या तो ‘कैरावन’ की रिपोर्ट एक प्लांटेड रिपोर्ट थी या ‘इंडियन एक्सप्रेस’ की यह रिपोर्ट प्लांटेड है, या दोनों रिपोर्ट ही प्लांटेड हैं किसी खास उद्देश्य को साधने के लिये। इस मामले की सचाई का पता आगे गहरी न्यायिक जाँच से ही चल सकता है।
फेसबुक पर पत्रकार आवेश तिवारी लिखते हैं –
“सुप्रीम कोर्ट में दो जजों की खंडपीठ ने 12 अगस्त 2013 को सोहराबुद्दीन इनकाउंटर केस में अमित शाह के मामले को मुंबई हाई कोर्ट को ट्रांसफर करते हुए हाईकोर्ट की एडमिनिस्ट्रेटिव कमेटी को एक चिट्ठी लिखी थी। उस चिट्ठी में कहा गया था कि अमित शाह के मामले में बिना देरी किये हुए न्यायिक प्रक्रिया को पूरी ईमानदारी से पूरी किया जाना चाहिए,हाईकोर्ट की प्रशासनिक कमेटी यह तय करेगी कि समूचे मामले में शुरू से लेकर पूरे ट्रायल के दौरान शुरू से अंत तक केवल एक ही व्यक्ति रहे।
लेकिन मुम्बई हाई कोर्ट में क्या हुआ? मुंबई हाई कोर्ट के चीफ जस्टिस मोहित शाह जिन पर जस्टिस लोया ने 100 करोड़ की रिश्वत की पेशकश का आरोप लगाया था केवल एक बार नही चार बार ट्रायल जजों को बदला।इनमे से एक जज जस्टिस लोया थे।
मोहित शाह की केवल एक कहानी नहीं है गुजरात हाईकोर्ट में 2007 में मोदी सरकार के खिलाफ एस्सार को 10 हजार करोड़ के टैक्स की छूट का मामला चल रहा था ,यह केस पहले मोहित शाह की अदालत में चला ,रोस्टर बदले जाने पर यह जस्टिस वाइ एस मीना की अदालत में आना था लेकिन तब तक एस्सार ने एक एफिडेविट दाखिल किया और मोहित शाह ने इस बड़े भ्रष्टाचार के केस को डिस्पोज आफ कर दिया,जबकि नियम यह है जब किसी मामले में सुनवाई को लेकर रोस्टर का परिवर्तन सुनिश्चित हो तो उक्त मामले में सुनवाई और निर्णय नहीं सुनाये जा सकते।
मार्च 2013 में सुप्रीम कोर्ट की कालेजियम ने मोहित शाह का नाम सुप्रीम कोर्ट के पैनल में यह कहकर अस्वीकार कर दिया कि न्याय को स्थापित करने के लिए ठीक नहीं है।कालेजियम ने कहा "he was not suitable to hold the office of Supreme Court judge and that his elevation would prove to be counter-productive and not conducive to administration of justice"
मोहित शाह 2010 से लेकर सितम्बर 2015 तक मुंबई हाई कोर्ट के चीफ जस्टिस रहे, 2000 से लेकर 2010 तक मुम्बई हाईकोर्ट ने 8 चीफ जस्टिस बदले गए।
मोहित शाह के खिलाफ लम्बी लड़ाई लड़ने वाले डॉ लियो रिबेलो और मुंबई हाईकोर्ट के कई वकील बताते हैं कि वो भाजपा अध्यक्ष अमित शाह के चचेरे भाई हैं।”
डॉ लियो रिबेलो ने मोहित शाह के खिलाफ मोर्चा खोला था, हमने उस खबर को भी प्रकाशित किया था। अब डॉ लियो रिबेलो का एक नया ईमेल आया है,जिसमें उन्होंने कई गंभीर आरोप लगाए हैं। हम उस पत्र को हू-ब-हू प्रकाशित कर रहे हैं। पत्र की भावना और तथ्यों की हम पुष्टि नहीं करते क्योंकि यह उच्चस्तरीय जाँच का विषय है, और हम कोई जाँच अधिकारी नहीं हैं।

DR. LEO REBELLO DISSECTS THE INDIAN EXPRESS STORY PLANTED HURRIEDLY TO SUBDUE CARAVAN STORY.
The Indian Express story has several lacunae.
1. Why IE is trying to negate the Caravan true story rather than corroborate it?
2. The ECG date is 30th Nov, when Heart Attack took place on 1st December is enough to nail the authenthicity of IE story.
3. It confirms that Mohit Shah, CJ of Bombay High Court, who had offered Rs.100/- crore to Judge BH Loya was present at the site of crime.
4. By the way, how many of you are aware that Mohit Shah and Amit Shah are cousin brothers? You too may confirm it.
5. IE should have investigated the fact that Mohit Shah was Judge in Gujarat High Court during Sohrabuddin case.
He had tried to meddle in the due process. Hence, he was transferred to Calcutta High Court, from where he managed his transfer to the Bombay High Court. From that vantage position, Caravan story has briefly referred how he managed transfer of judges, influenced, threatened judges working on Amit Shah's case, which amounts to clear contempt of the Supreme Court of India, which had said, decide the case on priority basis, and the same special CBI Judge will complete it from the beginning till the end.
6. Mohit Shah and his accomplices were present at the site of unnatural death of CBI Judge BH Loya to fudge the records.
7. Caravan story also mentions that Judge Loya was also not so keen on attending the wedding of Swapna Joshi's daughter.
But two Judges goaded him to accompany them. IE has not investigated who the two judges were.
8. Judge Loya's colleague, Swapna Joshi is now the Judge of the Bombay High Court. If Loya was alive today, Amit Shah would
be rotting in Jail along with Chhagan Bhujbal and Judge Loya would be the Judge of the Bombay High Court.
So, it is prima facie established that both brothers Mohit Shah and Amit Shah are the murderers of Honest Judge BH Loya as also others. They also tried to liquidate me.
9. Therefore, we want an Independent forensic inquiry and truth serum tests on those judges and corroboration of other facts.
10. And when the wife and children of the deceased Judge were in Mumbai, why was the dead body taken to a God forsaken place to avoid Mumbai's media glare and why such a serious case was not followed up by the Media? So, was media too silenced?
11. Prima Facie and Ex Facie evidence of Judge Loya's case and subsequent threats to his family prove more than what meets the eye.
Therefore, full CBI inquiry under SCI's hammer should be done. And in the meantime, Mohit Shah, the most corrupt CJ of the BHC who was here for 6 years, along with his accomplices like VM Kanade, should be sent to Jail on summary trial under Contempt of Court Act (proved), pending murder inquiry, so that he/they further does/do not influence, threaten, bribe others. I have more proof on SCI and BHC record of his and his accomplice VM Kanade's crimes of omission and commission which further proves how Brahmin Judges control everything in the judiciary.
