Yogi will be first sitting CM to go to jail – Rihai Manch
Lucknow, April 1, 2017. Rihai Manch has welcomed the decision of Allahabad High Court for asking the UP govt. to file a reply for not according sanction against Adiya Nath Yogi pending investigation in a case of spreading communal hatred under section 153 (A). Rihai Manch hopes Yogi would be prosecuted and would be first sitting CM to go to jail.
In a press statement Rihai Manch general secretary Rajeev Yadav has welcomed the decision of Allahabad High Court asking the state govt. to file a reply within three weeks for not according sanction for CBCID investigation into the case against Yogi Aditya Nath and others under section 153 (A) in a petition filed by social activist Pervez Parvaz and Asad Hayat after anti-Muslim communal riots in Gorakhpur in 2007.Akhlesh govt. did not accord the sanction for investigation during the last two years is enough to show that he, following the footsteps of his father Mulayam Singh, has been preventing the Sanghi elements from judicial actions. It is to be noted that there is provision of minimum three years of imprisonment involving the case of inflammatory speech under section 153 (A) but the sanction of the state govt. Is obligatory for the investigation.
The press statement says that on the night of January 7, 2007 Yogi Adityanath had delivered an inflammatory speech on the railway station of Gorakhpur in the presence of member assembly Radhey Mohan Das and mayor Anju Chaudhry wherein he had said that he would not let the raising of Tajiya by Muslim and play Holi with blood. He said he had told his people in the neighboring districts too. After the speech the crowd indulged in setting fire to the shops of Muslims chanting inflammatory slogans “Katue kate jayenge, Ram Ram chillayenge” (Muslim will be butchered and cry Ram Ram”. Apart from Gorakhpur anti-Muslim violence also spread to neighboring Devaria, Padrauna, Mahrajgang,Basti, Sant Kabeer Nagar and Siddarthnagr as Yogi had threatened. No FIR was register in this matter involving damage of Crores of rupees to the Muslims after which the social activist Pervez Parvaz and Asad Hasad file a petition in Allahabad High Court seeking direction for FIR to be filed. But the court rejected the plea and directed to follow the procedure under section 156 (3). Under the provision above the matter complain was lodged before the CJM Gorakhpur which he rejected after ten months.
The matter was once again brought before the high court and finally FIR could be lodged but the co-accused Anju Chaudhry took stay order against the FIR and the investigation thereafter. On Dec. 13, 2012 Supreme Court reject the SLP of Anju Chaudhry and ordered investigation but Akhlesh govt. did not accord
sanction to CBCID and proceeding remained pending.Had Akhlish govt. allowed CBCID to word Yogi Aditya Nath would have beenin jail for his sins today instead of being in CM house, Rajeev Yadav said. He said Riahi Manch hopes that fair trail is ensured by judiciary and Adityanath would be the first Chief Minister in office to go to jail.
Rihai Manch spokesperson Anil Yadav alledged black out this important news from media is another ugly example of embedded journalism. Media should understand the fact the killer cannot become saint by media portrayal. He also alleged that govt. and Sangh supported Hindutvised media is projecting Aditya Nath as Yogi and saint instead of Chief minister to create reverence for him and by this image making media is trying to psychologically prevent any criticism of Yogi for his administrative failures and lapses.
