Should judges be so touchy ?
Justice Markandey Katju
In my interview with Madhu Trehan ( see newslaundry.com ) I had referred to the behaviiour of CJI Thakur in the Supreme Court towards a senior advocate Dr. Rajiv Dhawan.
Dhawan had not abused the judges of the Supreme Court, and yet Justice Thakur lost his temper and cancelled the bail which he had granted a few moments earler to Subroto Roy, the Sahara chief, and behind Dhawan's back made some adverse remarks against him.

Was this proper on the part of a CJI ?
Should judges be so touchy ? And why should a client suffer even assuming his lawyer said something unpalatable to the judge ?
The even more shocking thing is that none of the senior Supreme Court lawyers came to Dhawan's defence in the matter. Obviously they remained mum because they do not want to displease judges, as they want favourable orders from them. That is why I call them 'Lawstitutes'.
P.S.
I must add that I was Dhawan's classmate in school in Allahabad ( the Boys High School, Allahabad, in which Amitabh Bachchan also studied ) but this post has nothing to do with that...
