When I was appointed Justice of Peace in 1978 for Greater Bombay, at my felicitation, I had spoken against police atrocities and abolition of barbaric, medieval death sentence. Since then every time Death by Hanging has been proclaimed or given wrongly, I have always repeated my demand. And in this I am NOT alone. If a national survey was conducted, the vote will be almost 90% in favour of Abolishing this Medieval, Barbaric Practice.
As the known Human Rights Activist (thrice short listed as a Member of Human Rights Commission but not appointed due to corrupt practice), World Peace Ambassador, my following 11 tweets of 31st and 30th July, 2015 candidly record the reasons:-
* MURDER IS MURDER, WHETHER DONE BY KNIFE, GUN, BOMB, FIRE, ACID, OR BY A JUDGE BY PEN BY FOLLOWING MEDIEVAL LAWS. ABOLISH DEATH SENTENCE NOW.
* Indian apex court created dubious history by sitting frm 3.00 AM, indulged in summary rejection, proved pre-planned execution of Yakub Memon.
* 30 July will go down in Indian History as Judicial Encounter Day, Death of Sanity, Death of Humanism, Death of Democracy & Goodbye to Shanti.
* 30th July will be remembered as the Death of Justice Day in India. For when dispensation becomes communal, Death of Democracy is guaranteed.
* This setting of hanging date for Yakub Memon and everything going with precision itself proves Death Sentence was premeditated.
* BJP: "Anyone who opposes the death sentence is mentally challenged". On the contrary. Those who support death sentence are barbarians.
* Yakub Memon - RIP. With that hopefully Terrorism too RIP? But for a Humane Society, I renew my demand since 1978 to Abolish Death Sentence.
* Home Minister sits with President of India for 2 hours & returns with President's decision to hang Memon. Where is President's discretion?
* Of all the Murders, Death Sentence is the worst. Along with the convict his family too dies slowly. I renew demand to Abolish Death Sentence.
* According to National Crime Record Bureau, death sentence was pronounced in 1303 cases since 2004. But only 4 have been hanged since then.
* Since 2004 four convicts have been hanged, 3 Muslims - Ajmal Kasab, Afzal Guru & Yakub Memon. Is Justice System turning communal?
Till such time as the Death Sentence is Abolished, I suggest the following measures: -
1.. The Sessions Court must avoid Death Sentence. In rarest of the rare cases dictum was the first step in that direction.
2.. The matter of Death Sentence, must first go to the State Human Rights Commission, full bench of 3 judges, and not to the State High Courts.
3.. If the Human Rights Commission decides favourably, No Appeal. If the Human Rights Commission too upholds the Death Sentence - in Rarest of the Rare Cases, it should then be Appealed in the Supreme Court of India consisting of 3 judges. Second Appeal, if any, should be before 5 judges.
4.. The President of India, elected Head of the State, should not be pressurised like Rajnath Singh, the Union Home Minister of BJP Govt, did on 29th July.
He sat there for two hours till Dr. Pranab Mukherjee signed the papers on dotted lines.
5.. The President should exercise his discretion by meditating on the issue seeking divine light.
